Object of the contract
These General Conditions have for object purchase of products, carried out remotely via data transmission, by Max-Model by L. Mattei, with registered office in Via Vicchio and Paterno, 6 50012 Bagno a Ripoli (FI), VAT number. 05845230480 - C.C.I.A.A - R.E.A. of FI-580184 owner of the site www.max-model.it. Each purchase transaction will be governed by the provisions of Legislative Decree n. 70/2003 (implementation of Directive 2000/31 / EC) and Legislative Decree n. 206/2005 (consumer code) and, as far as the protection of confidentiality is concerned, will be subjected to the regulations of Law n. 196/2003 and subsequent amendments.
Acceptance of the general sales conditions
The contract stipulated between Max-Model and the Customer must be considered concluded with the acceptance of the order by Max-Model. This acceptance is considered tacit. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general conditions and payment conditions shown below. If the Customer is a consumer (ie a natural person who buys the goods for purposes not related to his professional activity), once the purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale , in compliance with the provisions of articles 3 and 4 of Legislative Decree 185/1999 on distance selling and, as regards the protection of confidentiality, will be subjected to the legislation referred to in Law no. 196/2003 and subsequent amendments. Any right of the Customer to compensation for damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and / or things, caused by the non-acceptance, even partial, of an order is excluded.
How to buy
The Customer can only purchase products in the Max-Model catalog at the time the order is placed as described in the relevant information sheets. It is understood that the image accompanying the description of a product may not be fully representative of its features but may differ in color, size, and accessory products shown in the figure. All purchase support information is intended as a simple generic information material, not referable to the real characteristics of a single product. The correct receipt of the order is confirmed by Max-Model via an e-mail reply, sent to the e-mail address communicated by the Customer. This confirmation message will contain an 'Order Number', to be used in any further communication with Max-Model. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document. In case of non-acceptance of the order, Max-Model guarantees timely communication to the Customer. Right of Withdrawal
Pursuant to art. 5 DL 185/1999, if the customer is a consumer (that is a natural person who buys the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to Max-Model a reference to a Match VAT, has the right to terminate the purchase contract for any reason, without need to provide explanations and without any penalty, except as indicated in the following point.An essential requirement for the application of the right of withdrawal is that the product is not used and to exercise this right, the customer must send Max-Model a notice to that effect within 10 working days from the date of receipt of the goods This communication must be sent by registered letter with acknowledgment of receipt addressed to Max - Letizia Mattei model Via Vicchio and Paterno, 6 50012 Bagno a Ripoli (FI) or by telegram or fax always sent within the aforementioned 10-day deadline and followed by a confirmation by registered letter with acknowledgment of receipt, sent ABSOLUTELY within the following 48 hours. Once we have received the aforementioned withdrawal notice, the Max-Model Customer Service will quickly inform the customer of the instructions on how to return the goods to Max-Model within 10 days from the authorization. The right of withdrawal is subject to the following conditions: the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (eg: accessories, etc ...); the purchased good must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original packaging, we recommend, when possible, to insert it in a second package; in all cases, the attachment of labels or adhesive tapes directly to the original product packaging should be avoided; by law, the shipping costs for returning the goods are charged to the customer; the shipment, until the certificate of receipt in our warehouse is under the complete responsibility of the customer; in the event of damage to the goods during transport, Max-Model will notify the customer of the incident (within 5 working days from receipt of the good in its warehouses), to enable it to file a timely complaint against the courier chosen by him and obtain the repayment of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal; Max-Model is not responsible in any way for damage or theft / loss of goods returned with uninsured shipments; on arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the package and / or the original packaging are damaged, Max-Model will deduct from the refund due a percentage, in any case not exceeding 10% of the same, as a contribution to the costs of restoration. Without prejudice to any repair costs for proven damage to the original packaging, Max-Model will reimburse the customer the amount already paid, as quickly as possible and in any case within 30 days of the withdrawal request, by bank transfer. It will be the customer's responsibility to promptly provide the bank details on which to obtain the reimbursement (IBAN - Current Account of the invoice holder). The right of withdrawal is lost for lack of the essential condition of integrity of the good (packaging and / or its content), in cases where Max-Model ascertains: the lack of external packaging and / or original internal packaging; the absence of integral elements of the product; damage to the product for reasons other than transportation. In the case of forfeiture of the right of withdrawal, Max-Model will return the purchased good to the sender, charging the shipping costs to the sender. The consumer cannot exercise the right of withdrawal provided for in paragraphs 1 and 2 of Decree Law 22-5-1999, n. 185 for supply contracts of goods made to measure or clearly personalized.
Prices are to be considered not subject to VAT as Art.1 c.54-89 L.190/2014 Reg. forfettario and subject to possible variations.
The personal data requested when submitting the order is collected and processed in order to satisfy the express requests of the Customer and will not under any circumstances or to any title given to third parties. Max-Model guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code pursuant to Legislative Decree 196 of 30.06.03. Max-Model periodically sends advertising e-mails only to customers who have expressed their consent during registration by ticking the appropriate "Newsletter". INFORMATION ON THE PROCESSING OF PERSONAL DATA PURSUANT TO LEGISLATIVE DECREE NO. 196/2003 We inform you, pursuant to art. 13 of Legislative Decree 30 June 2003, n. 196 (Code regarding the protection of personal data), which Max-Model of Letizia Mattei, will process the personal data supplied by you in respect of the rights, fundamental freedoms and dignity of persons, with particular reference to confidentiality and to the personal identity as well as, in any case, in compliance with the legislation on the protection of personal data processing. The provision of data is optional, but a refusal to provide those marked with an asterisk determines the impossibility of accessing the services we offer. The personal data you provide are collected and managed by electronic means and processed, even with the aid of electronic means, or in any case automated, directly and / or through third party delegates (companies of proven seriousness, specialized in home delivery, in mailing and data entry) for the following purposes:
1. purposes related to the execution, management and payment of the purchase order;
2. promotional initiatives and sending of advertising information material, also through the use of electronic mail only if the customer has given his consent by blocking the "Newsletter" box during registration;
3. fulfillment of obligations provided by laws, regulations and community legislation. In any case, your data will not be disclosed (except to companies for home delivery, mailing and data entry), distributed or sold to third parties.
The data may be known as managers or agents only by specifically designated parties, operating in the Max-Model office. Pursuant to art. 7 of Legislative Decree 30 June 2003, n. 196, you have the right to obtain confirmation of the existence or not of personal data concerning you, even if not yet recorded, and their communication in intelligible form as well as the indication: - of the origin of personal data; - the purposes and methods of processing; - of the logic applied in the case of processing carried out with the aid of electronic instruments; - of the identification data concerning the data controller and data processors; - the subjects or categories of subjects to whom the data may be communicated or who can learn about them as managers or agents. You also have the right to obtain:
1. updating, rectification or, when interested, integration of data;
2. the cancellation, transformation into anonymous form, blocking of data processed in violation of the law, including those for which conservation is not necessary in relation to the purposes for which the data were collected or subsequently processed;
3. the attestation that the operations referred to in points 1. and 2. have been brought to the attention, also with regard to their content, of those to whom the data have been communicated and disseminated, except in the case where such fulfillment it proves impossible or involves the use of means manifestly disproportionate to the protected right.
Finally, you have the right to object, in whole or in part:
1. for legitimate reasons to the processing of personal data concerning you, even if pertinent to the purpose of collection;
2. to the processing of data concerning him for the purpose of sending advertising material or direct sales or for carrying out market research or commercial communication.

The sales contract between the Customer and Max-Model is considered concluded in Italy and regulated by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial competence is that of the reference forum of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Florence.
The sales contract between the customer and Max-Model of L. Mattei is considered concluded in Italy and regulated by Italian law.

Online resolution of consumer disputes
